What each rule means
US federal (FLSA): covered, non-exempt employees get at least 1.5 times the regular rate for hours over 40 in a workweek. Weeks may not be averaged.
California: 1.5 × for hours over 8 up to 12 in a day, over 40 regular hours in a week and the first 8 hours on the 7th day worked in a row in the workweek; 2 × over 12 hours in a day and over 8 on that 7th day. Alternative workweek schedules and exempt jobs are not applied. Source · DLSE Form 55 (Checked 2026-10-18)
Alaska: 1.5 × for hours over 8 in a day or over 40 in a week, counted once. Does not apply if the employer has fewer than 4 employees. Source (Checked 2026-10-18)
Nevada: 1.5 × over 40 hours in a week. Over 8 hours in a workday too, but only if you are paid less than 1.5 times the Nevada minimum wage (that is, under $18.00 an hour) and do not work an agreed schedule of 4 days of 10 hours. The calculator applies the daily rule only when the rate you enter is below $18.00. Some jobs and small businesses are exempt. Source · US DOL state minimum wage list (Checked 2026-10-18)
Colorado: 1.5 × after 40 hours in a week, or after 12 hours in a workday. Work over 12 consecutive hours that runs across two workdays also counts; this calculator does not check that. Some jobs are partly exempt. Source (Checked 2026-10-18)
Other states
Other states have their own minimum wage and some have other overtime rules that our calculators do not apply. Your state labor department has the rules for your job: US Department of Labor list of state labor offices
