What counts

Only the extra half of time-and-a-half required by the FLSA counts. For double time, only the FLSA half qualifies. Holiday or weekend premiums without more than 40 hours in a workweek, state-only overtime, pay to FLSA-exempt employees, and tips do not count.

For 2026 onward, look for W-2 box 12 code TT. For 2025, use box 14 or an employer statement showing the qualified premium. If it is not separately shown, divide total time-and-a-half overtime pay by 3. Do not enter the entire double-time premium as qualified overtime.

What it does not change

Social Security and Medicare tax still apply. State income tax is not covered: states decide whether to follow the deduction, and this tool does not model state tax. This reduces taxable income; it is not a refund of all overtime tax. Payroll withholding still applies.

Income phase-out examples

These tables assume enough qualified overtime to reach the cap. A smaller premium phases out sooner. MAGI steps round down to a whole number.

How it works

Add qualified overtime, apply the cap, then subtract $100.00 for each full $1,000.00 of MAGI above the threshold. The step count rounds down. Estimated savings use one marginal rate; your actual deduction may cross tax brackets.

Worked examples

  1. Time-and-a-half overtime pay of $15,000.00 includes $5,000.00 of qualified premium. At MAGI $65,000.00, the deduction is $5,000.00.
  2. At $20.00 per hour for 5 overtime hours each week over 52 weeks, the qualified premium is $2,600.00.
  3. A joint return with $9,000.00 plus $20,000.00 of qualified overtime and MAGI $310,000.00 has a combined deduction of $24,000.00.

Common questions

Is overtime tax free in 2026?

Only qualified overtime can reduce federal taxable income. Regular pay and payroll taxes still apply; this is not a refund of all tax on overtime.

How much overtime can I deduct?

Up to $12,500.00, or $25,000.00 combined on a joint return, before the MAGI phase-out. At $65,000.00 MAGI, $5,000.00 of qualified overtime gives a $5,000.00 deduction.

Does double time count?

Only the FLSA premium counts. For example, $20,000.00 of total double-time overtime pay gives $5,000.00 of qualified premium.

Do I need to itemize?

No. You may claim this deduction whether you itemize or take the standard deduction.

Does it lower Social Security and Medicare tax?

No. The deduction only affects federal income tax.

Which years are covered?

Tax years 2025 through 2028. Later-year form lines may change.
